Terms of use
The deal, in plain words
1. Who you are dealing with
Potilion is provided by:
Michael Kubín
IČO 07592264
č.p. 137, 294 31 Jizerní Vtelno, Czech Republic
Not registered for VAT.
A sole trader registered in the Czech trade register (živnostenský rejstřík).
By creating an account or using Potilion you agree to these terms. If you are using it on behalf of a company, you confirm you may bind that company to them.
2. What Potilion is
Potilion is a tool for building and publishing a company newsroom: an About section, a press contact, people, assets and news, on a public web address, structured so that journalists and AI search engines can read it. It also offers writing assistance (AI Draft and a coach) and lets journalists follow a newsroom by email.
3. Your content is public by design
A published newsroom is public. That is the point of it. Anything you publish can be read, indexed, quoted, and repeated by anyone, including search engines and AI systems, and we cannot take it back from them once it is out. Publish what you would say to a journalist on the record, and nothing you would not.
A draft is private to your account. A preview link is not indexed, but anyone holding the link can read the draft, so share it the way you would share a document.
4. Your content, your responsibility
You own what you put into Potilion. You give us a licence to host, store, display, process and transmit it as needed to run the service, including sending it to the AI provider described in the privacy notice when you use AI Draft or the coach. The licence ends when you delete the content or your account, except for copies already published elsewhere by third parties, which are outside our control.
You are responsible for your content: that it is accurate, that it is lawful, that you have the rights to it, and that the people you list in it (your team, your press contact) have agreed to appear on a public page with their name, role, photo and contact details.
AI Draft and the coach produce suggestions. They are written from what you and your website say, they can be wrong, and they are marked where they could not verify something. Read them before you publish. What you publish is yours.
5. What you may not do
- Publish content that is unlawful, defamatory, or infringes someone else's rights.
- Impersonate a company or person, or build a newsroom for a company you do not represent.
- Use the journalist follow feature to send anything other than that newsroom's own news.
- Scrape, overload, or interfere with the service, or try to get around a plan limit.
We may suspend or remove content or accounts that break these rules.
6. Plans and payment
The free plan is free. Paid plans are billed monthly through Stripe at the price shown when you subscribe. You can cancel at any time; the plan stays active until the end of the period you have paid for and is not renewed. We do not refund partial months.
If a subscription lapses, published newsrooms on that account come offline until it is renewed. The content stays in your account.
We may change prices with at least thirty days' notice by email. A change applies from your next renewal after the notice.
7. Availability and changes
Potilion is provided as it is. We work to keep it up and to keep your content safe, but we do not promise uninterrupted availability, and we may change, add or remove features. If we discontinue the service, we will give you at least thirty days to export your content.
8. Liability
To the extent Czech law allows, our liability to you for anything arising from these terms or the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost coverage, lost business, lost profit, or any indirect loss, nor for what third parties (journalists, search engines, AI systems) do with content you chose to publish.
Nothing here limits liability that cannot be limited by law, including for damage caused intentionally or by gross negligence, or the statutory rights of consumers.
9. Ending the relationship
You can delete a newsroom or your account at any time. Deleting a newsroom removes its content and uploaded files. We may terminate accounts that break these terms, and will say why.
10. Changes to these terms
We may update these terms. Material changes will be announced by email or in the app at least fourteen days before they apply. Continuing to use Potilion after that means you accept them.
11. Law and disputes
These terms are governed by the law of the Czech Republic. Disputes go to the Czech courts. If you are a consumer, you also keep every right consumer law gives you, and you may bring a dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz) for out-of-court settlement.
